Abstract:

The aim of the dissertation was an attempt to answer the question whether the provisions of both Polish Act on Copyright and Neighboring Rights and Code of Civil Procedure, on measures to preserve evidence, meet the needs of the practice and comply with the requirements of Directive 2004/48/EC. Among possible provisional measures to ensure the preservation of evidence should apply, in particular, a detailed description with or without the taking of samples, or the physical seizure of the infringing goods and the materials and tools used in the production and/or distribution of these goods and the documents relating thereto. Current Polish legal institution for preservation of evidence does not fully fulfil the postulate of the procedural preference of the injured party in civil proceedings in cases of copyright infringement.
